When visiting Recent Rates LLC (“RR”), you agree to abide by these Terms of Use, which may be updated from time to time without prior notice to you. It is essential to review our Privacy Policy alongside these terms to gain a comprehensive understanding of our practices. Together, these documents form an "Agreement" between you and RR concerning the use of our services.

Our Service

Recent Rates LLC offers U.S. consumers access to federal and state mortgage incentives, financial programs, savings calculators, and a network of lenders (the “Service” or “Rate Alerts”). To participate, you must provide certain details about yourself and your property—such as location and loan details —which RR uses to deliver custom mortgage rate alerts. Information is sent via email and SMS, with a maximum of ten (10) SMS messages and ten (10) emails per month. Standard message and data rates may apply. By opting into the Service, you consent to be contacted by RR via email and SMS. Carriers are not responsible for delayed or undelivered messages.

Not Professional Advisors

Financial decisions, particularly those involving mortgage loans, warrant careful consideration. RR and its representatives, including agents, employees, officers, subsidiaries, members, or partners, do not advocate for any specific decisions via this website or any other means without first advising you to seek professional guidance. We are not a mortgage lender, nor do we represent ourselves as such. The content provided on this site serves solely as informational and not as financial, accounting, legal, or other professional advice. Users of this site are encouraged to consult their own professional advisors for personalized guidance.

By accessing this site, you acknowledge and accept that you assume all risks associated with your interactions with RR or its partners. You acknowledge and understand that any decision to engage with any member or partner of this site is made at your own discretion and risk, and you are solely responsible for such interactions. RR shall not be held liable for any direct, indirect, incidental, punitive, or consequential damages of any nature arising from your engagements with investors, members, or partners of this site.

Communications Opt-Out Process

As a user of the Service, you may opt out of receiving communications from RR at any time. To opt out of email communications, you may click the Unsubscribe link at the bottom of any email message. To opt out of text message communications, you may reply STOP to any text message you receive. All opt out requests will be processed within a reasonable timeline and within federal, state, and local regulations.

We do not guarantee the successful delivery of email messages, or SMS messages by your wireless provider. Messages sent by SMS may not be delivered if the mobile device is not in range of a transmission site, or if the network is down. Factors such as the terrain, how close you are to buildings, foliage, weather, and your equipment may affect the delivery of SMS messages. We will not be liable for losses or damages that come from:

• a message not delivered,
• a message delivered late,
• a message that goes to the wrong number; or
• inaccurate or incomplete content in a text message.

1. You can cancel this service at any time. Just text "STOP" to (Placeholder). After you send the message "STOP" to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again. (Message frequency varies)
2. If at any time you forget what keywords are supported, just text "HELP" to (Placeholder). After you send the message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe.

4. T-Mobile is not liable for delayed or undelivered messages.

The trademarks and service marks displayed on our site, including “RecentRates.com," belong RR. These materials are not to be copied for commercial purposes or distribution, nor should they be altered or reposted on other websites. Additionally, framing any content is strictly prohibited.

RR provides you with a limited license to access and utilize this site for personal use only. You are not permitted to download or modify the site or any part of it without the explicit written consent of RR. User Obligations

We do not make any representations or warranties, whether express or implied, regarding the operation of this site or the accuracy, completeness, or reliability of the information, content, materials, or products included on this site. You acknowledge and agree that your use of this site is solely at your own risk.

To the fullest extent permitted by applicable law, RR disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not warrant that this site, its servers, or emails or text messages sent from the Service are free of viruses or other harmful components. Governing Law

By using the RR service, you agree to the laws of the state of California, without regard to principles of conflict of laws, will govern these Terms of Use and any disputes of any sort that might arise between you and RR.

ARBITRATION, CLASS ACTION WAIVER, JURY WAIVER

Please carefully read the following paragraphs as they outline the agreement between you and RR to resolve all disputes through binding individual arbitration.

• Applicability of Arbitration Agreement: You and RR agree that all claims and disputes, including contractual, tort, or statutory claims related to these Terms or the use of the Services, will be resolved by binding arbitration on an individual basis. However, disputes involving equitable relief for alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents are exempted from arbitration. This agreement covers claims that arose before the effective date of these Terms.
• Arbitration Rules: Arbitration will be governed by the Federal Arbitration Act, with ADR Services, Inc. serving as the arbitration provider. If ADR Services is unavailable, an alternative forum will be selected. The arbitration will take place in Los Angeles, CA, and the arbitral forum's rules will apply. Non-appearance-based arbitration may be utilized for claims under USD 10,000.
• Additional Rules for Non-appearance Arbitration: Non-appearance arbitration may be conducted via telephone, online, written submissions, or a combination thereof, chosen by the initiating party.
• Fees: ADR Services' fee schedule applies, with RR covering arbitration costs if it initiates the arbitration. If you initiate arbitration, you will pay the first $100 of the initial filing fee, while RR will cover the remainder and both parties' administrative fees.
• Authority of the Arbitrator: The arbitrator has jurisdiction to decide disputes and grant relief as per law and the Terms. The decision is final and binding.
• Waiver of Jury Trial: Both parties waive the right to a trial by jury and agree to resolve disputes through arbitration.
• Waiver of Class or Consolidated Actions: All disputes must be arbitrated or litigated individually, and class or consolidated actions are not permitted. Disputes regarding the validity of this waiver may be resolved by a court.
• Right to Waive: The rights and limitations in this Arbitration Agreement may be waived by the party against whom the claim is asserted.
• Opt-out: You have the option to opt out of this Arbitration Agreement within 30 days of becoming subject to it. To opt out, notify RR in writing.
• Small Claims Court: Either party may bring an individual action in small claims court.
• Arbitration Agreement Survival: This Arbitration Agreement remains in effect after the termination of your relationship with RR.

Acceptance of Terms of Use

By using this site, you affirm that you have comprehensively read, understood, and consented to adhere to this Agreement and the accompanying documents referenced herein. Your utilization or viewing of this site indicates your intent to enter into a legally binding contract. A printed copy of this Agreement and its referenced documents will be considered a valid "writing" under any relevant law or regulation.

Data Sharing and Disclosure

Non-Disclosure: Subscriber information will not be shared or sold to 3rd parties for their direct marketing and promotional purposes. No mobile information will be shared or sold to third parties for marketing/promotional purposes without your express consent. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
